Terms of Service

These Terms of Service ("Terms") govern your use of Emerge Mail (the "Service"), an OAuth broker that assists the Emerge Mail WordPress plugin in obtaining authorization to send email through a user's Gmail or Microsoft 365 mailbox. By using the Service you agree to these Terms.

1. The Service

The Service performs the OAuth authorization code exchange for the Gmail and Microsoft 365 connections of the plugin, and returns the resulting tokens to the WordPress site that initiated the flow. The Service does not store tokens, does not send email, and is not in the request path once tokens are delivered. Token storage, mail composition, and message delivery all occur inside the user's WordPress installation.

The plugin's other five providers — SendGrid, Mailgun, Amazon SES, Brevo, and Generic SMTP — use credentials entered directly by the user and transmitted from the WordPress site to the respective provider. The Service is not involved in those flows, and these Terms do not govern use of those providers (your relationship with each is governed by that provider's own terms).

2. Eligibility

You may use the Service only if you are authorized to administer the WordPress site you are connecting and are authorized to grant the requested permissions on the relevant Google or Microsoft account.

3. Acceptable use

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or violate the anti-spam laws applicable to your jurisdiction (including the CAN-SPAM Act, GDPR, and PECR).
• Impersonate any person or entity, or misrepresent the origin of a message.
• Bypass, probe, or otherwise interfere with the integrity of the Service, the connected email providers, or any third party.
• Use the Service in violation of the terms of Google, Microsoft, or any other upstream provider.

4. Third-party providers

Your use of Gmail and Microsoft 365 through the Service — and your use of any other email provider through the plugin (SendGrid, Mailgun, Amazon SES, Brevo, or your own SMTP server) — is also governed by the terms and policies of those providers. The Service does not modify or supersede those terms.

5. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATORS OF THE SERVICE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

7. Termination

You may stop using the Service at any time by disconnecting the mailbox from your WordPress site and revoking the application in your Google or Microsoft account. We may suspend or discontinue the Service, in whole or in part, at any time and for any reason.

8. Changes

We may update these Terms from time to time. Continued use of the Service after a change constitutes acceptance of the revised Terms.
