Terms of Service

These Terms of Service ("Terms") govern your use of Emerge: Mail Merge (the "Add-on"), a Google Workspace add-on that sends personalized mail-merge campaigns from a Google Sheet through your own Gmail account. By installing or using the Add-on, you agree to these Terms.

1. The Add-on

The Add-on runs inside Google Sheets under the permissions you grant. It reads the recipients and template from your spreadsheet, renders a personalized message for each row, and sends it through your own Gmail account. When you enable analytics, it provisions and reads a Google Analytics property in your own Analytics account and routes open/click events through a stateless relay, as described in the Privacy Policy.

2. Eligibility

You may use the Add-on only if you are authorized to use the Google account you connect it to and to send email from that account.

3. Intended use

The Add-on is intended for sending personalized email to recipients with whom you already have a relationship or from whom you have obtained consent — for example, updates, newsletters, and announcements to your own customers, subscribers, or contacts. The Add-on is not a tool for cold outreach, and you may not use it to send unsolicited commercial email ("cold email") to people who have not consented to hear from you, or for email warming, list scraping, or any use prohibited by Gmail's API and program policies.

4. Your responsibilities

You are solely responsible for the email you send through the Add-on, including its content and its recipients. You agree to:

• send only to people who have consented to receive email from you or whom you otherwise have a lawful basis to email, and honor opt-out requests promptly;
• comply with all applicable anti-spam and privacy laws, including the CAN-SPAM Act, GDPR, and PECR;
• comply with the Gmail bulk sender guidelines and Gmail's sending limits;
• not impersonate any person or entity or misrepresent the origin of a message;
• not use the Add-on to send unsolicited bulk or cold email, malware, or unlawful content.

5. Sending limits

Email is sent through your own Gmail account and is subject to Google's daily sending limits and policies. The Add-on does not raise those limits. Exceeding them, or violating Gmail's policies, may cause Google to throttle or suspend your account — which is outside our control.

6. Third-party services

Your use of Gmail, Google Sheets, and Google Analytics through the Add-on is also governed by Google's own terms and policies. The Add-on does not modify or supersede those terms.

7. No warranty

THE ADD-ON IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Add-on will be uninterrupted, error-free, or that every message will be delivered.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATORS OF THE ADD-ON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE ADD-ON.

9. Termination

You may stop using the Add-on at any time by uninstalling it and revoking its access in your Google Account permissions. We may suspend or discontinue the Add-on, in whole or in part, at any time and for any reason.

10. Changes

We may update these Terms from time to time. Continued use of the Add-on after a change constitutes acceptance of the revised Terms.
